The following Terms and Conditions details the relationship between
InterConnection Services by Design® (referred to as Icon in
this document) and the client regarding the authoring, publishing, and placement
of World Wide Web (WWW) pages.
Placement of Web Pages
1. The term pages refers to WWW, Web
or home pages specifically authored for the World Wide Web as
accessed through the Internet or other computer networks capable of providing
access to the World Wide Web.
2. The term placement refers to the placing of pages in a Web
server directory such that the pages are publicly accessible and possess
a unique Uniform Resource Locator (URL) address.
3. Icon reserves the right not to place or suspend current placements if
the materials fail to meet the terms and conditions detailed here, even if
ordered and paid for.
4. Domain names bought on behalf of a client are subject to availability.
5. Icon does not make any guarantees regarding placement or that placement
will occur on any specific date or dates or in any specific location.
Errors and Liabilities
1. Icon will use its best endeavors to ensure pages authored by Icon are
free of errors.
2. Icon may not be held responsible for any errors that may arise in the
course of authoring any pages.
3. Icon does not accept any liability for losses or damages arising from
errors within any page or if pages are not placed.
Permissions and Copyright
1. The client will obtain all the necessary permissions and authorities in
respect of the use of all copy, graphic graphics, registered company logos,
names and trademarks or any other supplied material.
2. Every order for page placement shall be regarded as a guarantee by the
client to Icon that all such permissions and authorities have been obtained.
Evidence of permissions and authorities may be requested.
3. No responsibility will be accepted by Icon for damages to or losses incurred
by the client from the use of material for which the required permission
or authority has not been obtained.
Web Page Content
1. All pages will include, at least, the name and telephone number and e-mail
address (if applicable) of the client. Icon may request evidence of authenticity
of this information prior to placement.
2. Icon reserves the right to append a hyperlink to Icons home page
at the very end or beginning of each page (specified by client).
3. Clients are required to ensure that the content of their pages meets all
the current U.S. legislation regarding publications. The client shall further
indemnify Icon in respect of any claims, costs or expenses that may arise
from any material included in their pages authored or placed on their behalf
by Icon.
Post-placement Alterations
1. Icon cannot accept responsibility for any alterations caused by third
party action occurring to the clients pages once placed.
2. Such alterations include, but are not limited to additions, modifications
or deletions.
Web Site Maintenance (optional)
Icon will perform web site maintenance, if requested, for a fee (see Pricing).
This includes:
1. Ensuring the web site is functioning properly (hyper-links, counter, etc.).
2. Monthly updates of text, within reason (up to 1/2 page).
If a site requires additions (more pages, photos, tables, etc.), then additional
rates may apply.
Payment Terms
1. Checks are to be made payable to John F. Rougeau
2. Icon requires signed written confirmation by letter detailing the agreed
work and amount before authoring work will begin.
3. The customer will be invoiced for web page authoring upon placement of
the order in writing.
4. Icon requires the client to pay 50% of the final agreed cost of the pages
upon placement of order.
5. Payment for the authoring must be received in full before the pages are
placed on the server.
6. In the event of a client wishing to delay final payment, a surcharge of
15% will be made on the outstanding amount.
7. Icon reserves the write not to place pages until final payment is
received.
Cancellations
1. Cancellation of orders for authoring or placement may, in the first instance,
be made by telephone or email, but must be confirmed in writing.
2. The client will be invoiced for authoring work completed to the date of
first notice of cancellation for payment in full within 30 days.
3. The full invoiced amount of the order must be paid if the cancellation
is not received in writing within 10 working days.
Alterations to Terms and Conditions
1. Icon reserves the right to change, at any time, the terms and conditions
of the acceptance of orders for authoring and placement of clients
pages.
Acceptance of Terms and Conditions
1. The placement of an order or contract for the authoring or placement of
pages with Icon will be regarded as an acceptance of all of the above terms
and conditions.
2. Orders may be placed, in the first instance, by telephone or email and
must be confirmed in writing , including a signed copy of these terms and
conditions.
